Parts and Panels Warranty - Terms and Conditions

Important note: The consumer guarantees in the Australian Consumer Law may also apply to the Parts and Panels which are the subject of this warranty. Nothing in this warranty excludes or limits any rights you may have under the Australian Consumer Law. For more details, see section 9 below.

1. What is covered by this warranty?

1.1  Parts installed during repair or service?

  • Mazda warrants to repair or replace (at its option) any Part installed by a Dealer in or on a Mazda Vehicle in the course of Repair or Service of that Mazda Vehicle if that Part does not perform its normal function.
  • The Warranty commences on the date of the invoice for the Service or Repair and remains in effect for so long as you own the Mazda Vehicle in which the Part was installed by the Dealer.
  • To honour this Warranty, Mazda will ensure that a Dealer will, without charge to you, repair or replace the Part, using new or remanufactured parts, to correct any defect in that Part covered by this Warranty.

1.2  Parts sold other than in the course of repair or service

Mazda warrants to repair or replace (at its option) any Part sold by a Dealer to you (or your agent), other than in the course of Repair or Service, that does not perform its normal function after being installed on a Mazda Vehicle.

The Warranty commences on the date of invoice for the sale of the Part and terminates on the earlier of:

(a) 24 months after the date of invoice; or

(b) when the Mazda Vehicle on which the Part is installed has been driven for a distance of 40,000 kilometres after the Part has been installed.

To honour this Warranty, Mazda will ensure that a Dealer will, without charge to you, repair or replace the Part, to correct any defect in that Part covered by this Warranty.

1.3 Panels

Mazda warrants to replace any Panel sold by a Dealer to you (or your agent), other than in the course of Repair or Service, that is damaged by Perforation after being installed on a Mazda Vehicle.

The Warranty commences on the date of the invoice for the sale of the Panel and terminates 72 months after that date.

To honour this Warranty, Mazda will ensure that a Dealer will, without charge to you, supply a replacement panel, to correct any defect in that Panel covered by this Warranty.

3. Warranty application

This Warranty is personal to you and cannot be assigned, novated or in any way transferred to another person, including any subsequent owner of the Mazda Vehicle.

4. How to claim under this warranty

To make a claim under this Warranty, you must take the following steps:

Contact the Dealer who sold the Part or Panel or who conducted the Repair or Service. If this is not reasonably practicable, contact your closest Dealer. If you feel that you still need assistance, please contact Mazda using the details in clause 2.

Then, take your Mazda Vehicle to the Dealer. You will need to provide the following information at the time of making the claim:

(a) Your name, address and telephone number.
(b) The invoice for the relevant Part, Repair, Service or Panel.
(c) Evidence, including receipts, of all work, including scheduled maintenance and service work, performed on your Mazda Vehicle by persons other than a Dealer.
(d) The nature of your claim, and all material details related to your claim.

If you do not produce the relevant invoice for the Part, Repair, Service or Panel (as the case may be) when making a claim, you will invalidate this Warranty.

5. Limitation of liability and remedy

This Warranty is given in lieu of all other express warranties (except those set out separately by Mazda in writing) given by Mazda or the Dealer supplying the Part or Panel (as the case may be). No Dealer, or any agent or employee thereof, is authorised to extend or enlarge this Warranty.

This Warranty does not affect any statutory rights of persons purchasing a Part or Panel and are additional to those rights.

6. Your responsibilities

You are responsible for properly operating and maintaining your Mazda Vehicle in accordance with the instructions described in the Owner’s Manual. You should retain evidence that proper maintenance has been performed for Warranty protection.

If you do not do these things, you may void this Warranty.

7. What is not covered by this warranty?

7.1 General exclusions

This Warranty does not apply to:

(a) a Part or Panel that has at any time been installed in or on a vehicle other than a Mazda Vehicle for which the Part or Panel was sold by the Dealer; or

(b) repair or replacement of a Part or Panel required as a result of:

(i) the Mazda Vehicle suffering a collision, or being subject to accidental damage, fire or illegal or malicious use; or

(ii) misuse, including use of a Part or Panel, or use of the Mazda Vehicle, in a manner other than that intended by the Owner’s Manual; or

(iii) lack of proper maintenance in accordance with the Owner’s Manual; or

(iv) repairs improperly performed or replacements improperly installed by any person other than a Dealer; or

(v) a replacement part or accessory not approved by Mazda; or

(vi) usage of any fuel other than that specified for the Mazda Vehicle; or

(vii) remodelling without approval by Mazda; or

(viii) damage from environmental conditions such as airborne fallout, salt, hail, windstorm, lighting, flood and the like; or

(c) Parts or Panels installed to vehicles used for competition, racing or emergency purposes; or

(d) any Parts that suffer deterioration as an ordinary result of usage, or that typically would be subject to a maintenance or replacement schedule, such as, but not limited to, batteries; additives (anti-freeze, oil and the like); seals; gaskets; soft and hard trim items; glass; filters of any type; spark plugs; high tension leads; drive belts; timing belts; fuses; light bulbs; pcv valves; brake discs; linings and pads; clutch linings and pads; hoses and air conditioner receiver driers; or

(e) Parts or Panels replaced under the provisions of Mazda New Vehicle Warranty or any other warranty, including where the repair cost has been partly paid for by Mazda or a Dealer; or

(f) repairs that only have a labour cost; or

(g) Parts installed during Repair or Service deemed inappropriate by the Dealer but performed at the request of you (or your agent).

7.2 Extra expenses and damages

Except for the actual cost of repair or replacement, you are responsible for all other expenses associated with making a claim under this Warranty.

This Warranty does not make Mazda liable for:

(a) any consequential, indirect or incidental damages; or
(b) the labour costs associated with installing the replacement part or panel unless the Part or Panel was originally installed by a Dealer.

 8. Definitions

“Dealer” means a company authorised by Mazda to sell Mazda Vehicles and provide service for such Vehicles.

“Mazda” means Mazda Australia Pty Limited ABN 78 004 690 804.

“Mazda Vehicle” means a motor vehicle distributed in Australia by Mazda that has an ADR compliance plate and is used in Australia.

“Panel” means a new sheetmetal body panel for a Mazda Vehicle that is sourced from Mazda and is sold by a Dealer to you (or your agent), as identified on the relevant invoice and accompanied by this Warranty document.

“Part” means a part or accessory, but does not include a Panel, that is sourced from Mazda, as identified on the relevant invoice and accompanied by this Warranty document, and is:

(a) installed by a Dealer in or on a Mazda Vehicle in the course of Repair or Service; or
(b) sold by a Dealer to you (or your agent) other than in the course of Repair or Service.

“Perforation” means rust or corrosion completely through the Panel.

“Repair” means the repair of a Mazda Vehicle by a Dealer.

“Service” means the systematic maintenance service of a Mazda Vehicle by a Dealer, as recommended in the Owner’s Manual, but does not include Repair.

“you” means the owner of the Mazda Vehicle as at the date of invoice for which the Part, Repair, Service or Panel (as the case may be) was supplied and to which this Warranty relates.

9. Australian Consumer Law – Warranty against defects

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
