Terms of Use - Mazda 6e Application
I. Scope
These Terms of Use ("Terms of Use ") apply to
- the registering of your Mazda6e App account for linking the vehicle with your Mazda6e App (amongst other things, to activate the SIM card in your vehicle) and
- the use of the additional remote-control related functions and services (see Section 4 below),
each as provided via the Mazda6e Application (“App”, together “Services”). The App is provided by Mazda Australia Pty Ltd (ACN 004 690 804) (hereinafter referred to as “MA”, "Mazda", "we", "us" or "our").
These Terms of Use are a legal agreement between you ("User" or "you") and MA.
You can find the most current applicable Terms of Use and our Privacy Policy at any time in the App’s menu.

II. General Information
The agreement governing the use of the Services via the Mazda6e App in accordance with these Terms of Use and the purchase agreement for your Mazda vehicle are legally separate agreements. Unless indicated otherwise in these Terms of Use, the performance of one of the agreements shall have no implications on the respective other agreement.
Please note: You can only access and use the Services if you have an active account in our App and agreed to the relevant Terms of Use as well as acknowledged the Privacy Policy in the vehicle.
The agreement is concluded when the User is activated and granted access to the Services in the App after having successfully registered. You are provided with setting options in the subscription process with which you can correct any input errors. The agreement is concluded in the language you have selected as the App language. These Terms of Use will also be available for you to download at any time within a separate landing page which will be accessible and opened via the in-App browser.
The Services can only be used for Mazda vehicles you added via the App. The Mazda6e App will provide you with the following key Services:
- User Account
- Vehicle Linking / Authority Sharing
- Remote Control
- Digital Key
- Owner Manual
III. User Account and Vehicle Linking
To use the vehicle Features, you need to register through the Mazda6e App and bind the vehicle to our centralized vehicle backend with the support of your dealer.
1. User Account

- Vehicle binding
- Scan QR code to register of the vehicle user account
Our service enables you to register and manage your account in the App. This includes creating and cancelling/deleting your account, logging in and out, updating account details (change email address and reset password), linking email address as the owner, and activating/deactivating the in-vehicle’s SIM card.
Please note: In order to activate the SIM card in the vehicle necessary to activate certain vehicle features and services the user must set up a user account in the App and bind the vehicle with the App. Deleting your user account also deactivates the vehicle SIM card. In this case, any vehicle functions and remote app functions in use will then no longer be available.

Our service enables secure authorisation and management of vehicle ownership and access rights through the App. When a vehicle is linked to an owner’s account, an authorisation code is sent to the owner's email address based on a request from the original equipment manufacturer (OEM). This ensures that vehicle features are properly assigned to the owner and allows the owner to share vehicle access with non-owners in a controlled manner.
IV. Remote-Control Services
To use the remote-control services, you need to register through the Mazda6e App and bind the vehicle to our centralized vehicle backend with the support of your dealer. Activating your account through the Mazda6e App is a prerequisite to connect the vehicle to the vehicle backend which is necessary for making use of the Features and Services related to your vehicle, such as remote-control services including alerts (e.g. child detection in the car).

Our service provides vehicle owners with remote access and control features through the App, allowing them to monitor their vehicle’s status, manage security settings, and optimise charging and heating Services.
2. Digital Key
- Activate, download and deactivate digital keys
- Share digital keys
- Manage your digital key data in TSP
The digital key Services allows users to activate, download and deactivate digital keys, to share digital keys and to manage your digital key data. You can use your digital key to unlock/lock the vehicle, open/close the window, open/close the trunk, flash the lights, open/close the electric tailgate, start the vehicle and for other relevant car controls.

The vehicle owner / App User can access the above Manuals from the App.
V. Updates
MA will ensure that any updates required to maintain the Services via the Mazda6e App in accordance with these Terms of Use are provided during the term of these Terms of Use. Updates may be required, for example, to maintain the functionality or compatibility or security. The User will be notified when updates are available.
VI. User Obligations
You may only use the Services for the intended (see above) purposes. In particular, you must not:
- use the Services for unlawful purposes or cause, enable or facilitate that third parties use the Services for unlawful purposes,
- wilfully disrupt or interfere with the Services by any means,
- You must not use the Services for anything that is defamatory, abusive, obscene, indecent, or harassing, or that threatens or encourages bodily harm, destruction of property, or infringement of the lawful rights of any party (including privacy rights), or for any unlawful purposes or to facilitate that third parties use the Services for such purposes,
- You must not wilfully disrupt or interfere with the Services by any

VII. Data Protection and Privacy Policy
Where we process your personal data in connection with the provision of the Services, we do so in accordance with applicable laws and our Privacy Policy which is available in the App under “Me”- “About Us”- “Privacy Policy”. Please see this Privacy Policy for details on data processing.
Whenever you assert your rights as a data subject or make declarations under data protection law (e.g. withdrawal of consent), this shall not affect the validity of these Terms of Use.
VIII. Copyright/Intellectual Property
The entire content of the Services and all related rights are owned by Mazda and its direct or indirect subsidiaries (hereinafter referred to collectively as "Mazda") or third parties.
Without our prior permission you may only use the Services in accordance with these Terms of Use. In particular, you must not use the Services for any public or commercial purposes.
You shall not use any image, trademark, service mark or logo related to the Services. By allowing the use of the Services in accordance with these Terms of Use no such right or licence is granted.
IX. Term and Free Services
The Services are currently free of charge. The use of the Services will begin on the date you have been registered at the Mazda6e App account and added a related Mazda vehicle. You will need a VIN (Vehicle Identification Number) in order to use the Services. Please be aware that anyone who registers into the Mazda6e App, and has a knowledge of your VIN can assign your Mazda vehicle to its account by entering the VIN. It is your responsibility not to share your VIN to any unauthorised parties. If the Mazda vehicle which has been registered in your Mazda6e App account is sold or transferred, the new owner or lessee will also be able to subscribe to the Services.
X. Termination
1. Your Cancellation Rights
You can cancel the Services at any time, with or without cause, by logging into your Mazda6e account and removing your account. To remove your account, you need first to unbind the vehicle, thereafter you can delete your account (“Unsubscribe”). There is no charge to cancel your subscription. The cancellation effective date is the date you delete your Mazda6e account or removed your Mazda vehicle and, upon such cancellation, we have the right to immediately turn off access to the Services for you.
Please note: If you choose to terminate your account (in the App’s Menu) it also deactivates the vehicle SIM card that was activated when the app account was registered and bound with your vehicle. Any vehicle functions and remote app functions in use will then no longer be available.
If you just want to modify or deactivate the remote-control services, you can modify or deactivate / unsubscribe them at any time in the settings of the vehicle or in the App.
It is your responsibility to cancel the Services subscription by unlinking the vehicle in the App prior to selling, transferring, or terminating the lease on your registered vehicle. We reserve the right to immediately cancel the Services once notified of the sale or lease termination of your vehicle by you, a Mazda Dealer/Repairer, or new owner/lessee.
2. Our Cancellation Rights
Without Cause: We may suspend or terminate your subscription at any time without cause subject to a reasonable prior notice considering the circumstances and the reasons of the suspensions or the termination. This means that we can decide to cease providing the Services to you at any time and for any reason, even for reasons unrelated to you or your subscription with us.
With Cause: We may terminate your subscription for any good cause, at any time, and without prior notice to you. This means, for example, we can terminate your subscription immediately if you breach any part of this agreement, interfere with our Service efforts, interfere with our business, or if you use Services for illegal or improper purposes or if revised Terms of Use will not be accepted. You do not have any right to have your subscription reactivated, even if you cure any of these issues. We may, in our sole discretion, allow reactivation of your subscription.
XI. Changes
We reserve the right to amend these Terms of Use or the Services due to future economic, legal and technical developments in line with the following provisions.
Changes that are legally advantageous or neutral to you shall take effect immediately.
Further, we may only make changes to the Services that go beyond what is required to maintain conformity with the contract (e.g. updates, cf. Section V) if there is a valid reason for such a change, the change does not involve additional costs for you nor changes the essence of the Services and you are informed in clear and understandable language of the change.
A valid reason shall exist if the change is necessary in order to
- improve access to and usability of the Services (including introducing new or enhances existing Services);
- adapt the Services to amended legal requirements;
- adapt the Services to technical changes or developments in systems operated by us or third parties or to technical developments in our users' systems;
- changes necessary due to important operational reasons;
- changes resulting from the need to remove ambiguities, errors or clerical mistakes possibly occurring in the Terms of Use; or
- changes to the contact details, names, identification numbers, electronic addresses or links provided in the Terms of
In case of changes that have significant negative impact on your access to or the usability of the Services, you will be informed with reasonable advance notice in clear and understandable language by means of a durable medium about the features and timing of the change and your right to terminate the contract free of charge at any time; unless we provide you access to and use of the unchanged Services at no additional cost.
Otherwise, in case of all other material changes to these Terms, we will notify you of the intended changes with reasonable advance notice.
If you do not tell us otherwise in writing (for example by sending a letter or email) within two weeks after our notification, you will be deemed to have accepted the changes (we will remind you of this when we inform you about the intended changes).
If you tell us that you do not accept the changes, we may terminate our contract based on these Terms with effect from the date on which the changes should have applied.
XII. Warranty
1. Applicability of the statutory warranty provisions
In the event that the Services provided are defective, warranty obligations shall be in accordance with the applicable statutory warranty provisions.
2. Rights in case of defects and updates
In addition, the following shall apply with regard to the Services:
If the User does not install an update or fails to install it properly, Mazda shall not be liable for any defects of the Services caused through the lack of the particular update.
As a general rule, if the Services including its updates show defects, it shall be presumed that the Services were defective during the previous period of the provision. This does not apply if
- the User's digital environment was not compatible with the technical requirements of the Services at the relevant time as communicated by Mazda, or
- Mazda cannot investigate whether the technical requirements have been complied with as a consequence of the User’s refusal to cooperate in investigating the relevant circumstances in an appropriate manner and where possible for these purposes and Mazda intends to use technical means to determine the relevant circumstances that represent the least intrusion for the
When you assert your claims in connection with defects you shall cooperate with Mazda to the extent reasonably necessary and possible to enable Mazda to investigate whether the cause of the defect was in your digital environment. The duty to cooperate is limited to the technically available means that are the least intrusive for you.
XIII. Liability
Subject to the provisions below, Mazda shall not be liable for the error-free servicing and availability of the Services.
In addition, the following rules shall apply:
- Mazda shall be liable in accordance with the applicable statutory provisions (whether in contract, tort or otherwise) for damages suffered by you that
- have been caused as a result of us, our legal representatives, our agents or auxiliaries having acted, or having failed to act where there was a duty for us to act, in gross negligence or with wilful or malicious intent,
- have occurred as a result of a breach of a guarantee (the term “guarantee” in accordance with the applicable statutory meaning),
- have occurred as a result of us breaching a material contractual obligation (as regards the term “material contractual obligation” see b. ),
- that are a result of a culpably caused injury to life, limb, or health, and/or
- that are subject to product liability under any applicable liability
- In cases of negligence (other than gross negligence) in breaching a material obligation under the agreement, our liability shall be limited to damages that are typically foreseeable in the context of a contract such as the agreement under these Terms of The foregoing limitation of liability shall, however, not apply where the damages result from culpably caused injuries to life, limb or health or a breach of a guarantee (as defined above).
- “Material contractual obligations” are such contractual obligations, the fulfilment of which is essential for the proper performance of the agreement and on which the contractual partner may rightfully rely, and that, on the other hand, jeopardise the aim and purpose of the agreement if
- Any liability other than or beyond the liability provided above is
- Notwithstanding anything to the contrary in this Section XIII, we shall not be liable for damages, if and to the extent they are caused by your own negligence, wilful misconduct, or other
- Nothing in the agreement excludes, restricts or modifies any consumer guarantee, right or remedy conferred on a party by the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded, restricted or modified by agreement.
XIV. Miscellaneous
These Terms of Use and any data protection declaration (e.g. your consent) are the entire agreement between MA and the User regarding the use of the Services and supersede all prior agreements, written or oral, with respect to the subject.
Deviating, conflicting or supplementing Terms of Use of the User shall not apply to the use of the Services unless explicitly accepted by us in writing.
Any amendments and additions to the Terms of Use as well as notifications necessary for their execution require text form (including email, fax) to be effective. The text form requirement can only be overruled in text form.
If any term of our contract should be found invalid, you and we agree that the other terms of our contract shall remain valid and unaffected.
Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Even if we delay the enforcement of this contract, we can still enforce it later. If we do not insist immediately that you take any action that is required under these Terms, or if we delay in taking steps against you in the event that you violate this contract, this will not mean that you do not have to take this action, and it will not prevent us taking steps against you at a later date.
XV. Applicable law and place of juridiction
These Terms of Use shall be governed and construed in accordance with the laws of Victoria, Australia excluding any conflict of law provisions that would require application of another choice of law.
Further, if you are a consumer within the meaning of the applicable laws, all mandatory statutory consumer protection laws, and regulations applicable in the country in which you generally reside shall apply, if and inasmuch as those laws and regulations provide you with a more extensive protection.
The courts of Victoria and the Commonwealth of Australia, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms of Use. In addition, as a consumer, you may bring proceedings in the courts of your current domicile. In this case, each of the Parties hereby expressly consents and submits to the jurisdiction and venue of these courts.

Mazda is not obligated to and does not participate in any voluntary alternative dispute resolution procedures before an alternative dispute resolution body for consumers.
