Privacy Policy

1. Introduction

Mazda Australia Pty Ltd (ACN 004 690 804) (Mazda, us, we, our) is committed to protecting the privacy of individuals.  Mazda is bound by the Privacy Principles set out in the Privacy Act 1988 (Commonwealth) (the Act).

This policy concerns your (you, your) personal information (Privacy Policy). Mazda will only collect, use or disclose personal information in accordance with the Act and this Privacy Policy.

By providing your personal information to us you accept the terms of this Privacy Policy.

Mazda may amend this Privacy Policy at any time.  The updated version will be available by following the “Privacy Policy” link on Mazda’s website homepage, at www.mazda.com.au (Site).  Mazda may highlight changes to this Privacy Policy on its homepage, but you should check the Privacy Policy regularly for changes.

In this Privacy Policy, “personal information” has the meaning set out in the Act.  Essentially, personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. 

 

2. The Mazda Family

Mazda collects and shares your personal information with other members of the Mazda Family which includes its dealers and parent company (Mazda Motor Corporation) to allow you to be known across Mazda network regardless of which Mazda entity you choose to deal with and to provide you an integrated service with products, services, information and assistance, respond to your enquiries and help keep your information up to date.

Mazda dealers are independent franchises of Mazda and may have privacy policies which differ from ours. We collect personal information from Mazda dealers, but they are responsible for their own privacy policies and privacy practices.  Please contact your Mazda dealer directly for further information.

4. What kinds of personal information do we collect?

The kinds of personal information that we collect and hold about you will depend on the nature of your dealings with us.  We have outlined some specific examples below.

If you do not wish to provide us with your personal information, we may not be able to respond to your query, provide you with our products and services or assess your application or eligibility for a product or service.

Mazda does not require customers to provide any sensitive information (which includes information about your health, race, ethnic origin and religious beliefs).  If you do provide sensitive information to us for any reason (for example, if you provide us with information about a disability you have or other health related information), you consent to us collecting that information and to us using and disclosing that information for the purpose for which you disclosed it to us and as permitted by the Act.  In the case of business-related purchases, sensitive information in relation to an individual’s membership of a trade or similar association may be provided to us but we do not actively seek this information.

If you provide us with personal information about another person, you need to tell the other person about this policy so they are aware that you have provided their information to us and that they can read this policy to understand how their information will be handled. You must obtain all necessary consents from the other person before supplying their personal information to us (including a parent or legal guardian’s permission for minors).

 

5. Personal information – collection/use and disclosure

When you purchase or use goods or services from Mazda Family, submit product enquiries to us, visit Mazda premises, respond to our surveys or engage with us online or by telephone, we collect personal information about you (both from you and from third parties) to assist us in providing our goods and services to you.

We may also disclose this personal information to third parties to assist us with providing our goods and services to you, to enable us to improve the quality of our goods and services, or to meet our regulatory obligations.

5.1 What type of personal information do we collect?

The types of personal information we collect from you will depend on the circumstances in which the information is collected.

Mazda may collect contact details including your name, address, email address and phone number. Where relevant, we may also collect information in relation to financing your Mazda vehicle, answers you provide to questions we ask and other information in relation to your dealings with Mazda or Mazda dealers (such as types of vehicle purchased and replaced, repairs and service history), and any other personal information that you submit to us, via our websites, including our Site.

Mazda may also collect personal information through the MyMazda App including vehicle details (such as VIN), vehicle use (including odometer reading and fuel levels) and driving data (including collision and accident information). This information is used for Mazda business purposes (including improving our products and services), and for us to provide you, and any other MyMazda App user, tailored services.

Any credit card/banking details that you provide to Mazda or our service providers will be collected via a secure third party payment processing platform which will process the payment. The third party will then provide us with confirmation of your payment. The third party does not share your credit card details with us.

In some cases Mazda may also collect demographic information such as your age, occupation and approximate income.  This information is sought to assist us to better understand and service our customers.  

Some of Mazda's vehicles include an optional Driver Personalization System that allows you to create a Driver Profile that automatically adjusts your vehicle’s settings to your personal preferences. For example, the Driver Profile allows you to save and adjust your seat and mirror settings to your preferences and allows other drivers of your vehicle who create a profile to do the same.

If you have a compatible model and elect to create a driver profile in the Driver Personalization System, the camera in your vehicle scans features of your face and converts them into numeric information (a “Driver Profile”). This Driver Profile is used to recognise your face when you sit in the driver's seat and automatically restore your preferred settings. Your Driver Profile is secured, locally stored on your vehicle only, and is not transmitted to or subject to remote access by Mazda. When this feature is enabled, the camera will scan the face of the driver and automatically check the converted numeric information of the driver's face against the saved Driver Profiles, and if a match is found, the vehicle adjusts the driver vehicle settings to that saved Driver Profile. This is a convenience feature that is off by default and you can set on or off. You can adjust vehicle settings manually instead of using the Driver Personalization System.

 

5.2 How do we collect personal information?

We collect personal information in the following ways:

  • when you request a brochure, use the MyMazda App (MyMazda App), register as a user on the MyMazda App, create a Driver Profile in the Driver Personalization System, join a mailing list or request information including from the Mazda website or at a motor show, Mazda Drive Day or other promotional day such as MDay;
    • when you participate on our social media platforms;
    • when you enter a competition on our Site or respond to a survey;
    • if you apply for a job at Mazda;
    • when you conduct business with us; or
    • if you otherwise submit personal information about yourself, or someone else, to us, or our Mazda site.
  • We may collect your personal information from a Mazda dealer when you:
    • make an enquiry about our products and services;
    • take a test drive at a Mazda dealer;
    • purchase a new or used Mazda vehicle or Mazda parts from a Mazda dealer;
    • arrange finance for the purchase of a new or used vehicle; or
    • have a vehicle serviced or repaired at a Mazda dealer.

We may also collect personal information about you from publicly available sources, from our related companies or from third parties.

Whenever you visit or interact with a Mazda website or other online platform of ours, we, as well as any third-party service provider and/or advertiser, may use a variety of technologies that automatically or passively record information about how the platform is accessed and used. 

This information we may collect includes:

    • your IP address or other unique identifier for the device used to access a platform;
    • email address, username, or other unique user identifier;
    • aggregated multi-platform information about Google users who have enabled personalised advertising on their Google accounts (Google Signals Data);
    • browser information;
    • “Device” type (computer, mobile phone, tablet or other device);
    • operation system and/or application version; and
    • date and time of visit, pages viewed, preceding page views and your use of features or applications on the platform such as interactions with connections or groups.

This information helps us keep our platforms relevant to users and allows us to tailor content to a user’s interests. Such information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we will treat it as personal information.

 

5.3 How do we use personal information (and why)?

This Privacy Policy deals with personal information of web users, registered users of the MyMazda App, job applicants, customers, service providers and other third parties. The purposes for which we use your personal information will depend on the circumstances in which we collected it.

For example, we may use your personal information so that:

  • we can provide you with our services or services you request through us;
  • we can do business together;
  • we can consider you for employment or other relationships; or
  • you can use our website.

We may use or disclose your personal information:

  • for the purposes for which we collected it (and related purposes which would be reasonably expected by you, or, in the case of any sensitive information, directly related purposes which would be reasonably expected by you);
  • for other purposes to which you have consented; and
  • as otherwise authorised or required by law.

Generally, we will only use and disclose the personal information that we collect about you for purposes connected with our business operations.  These purposes may include:

  • to assist you conveniently and easily accessing the services that we offer and provide;
  • to target and personalise our web-based content to you;
  • verifying your identity and fraud prevention;
  • contacting you (including via the MyMazda App, electronic messaging such as SMS and email, by mail, by phone or in any other lawful manner);
  • contacting you in respect of recall activities;
  • assessing your suitability for employment or other relationships with us;
  • providing goods or services to you or receiving goods or services from you;
  • marketing, advertising and sales;
  • addressing any issues or complaints that we or you have regarding our relationship; and
  • developing and improving our business.

For example, when you purchase a vehicle from a Mazda dealer, we may use the information you provide (via the dealer) to contact you with a reminder when the vehicle is due for a service.

We may also use your personal information:

  • to contact you with further information about, and to seek feedback on, our products and services and the products and services of Mazda dealers and our third-party marketing partners;
  • to periodically send communications about offers, events, competitions, promotions, products, surveys or other information which we consider that you may find interesting (see section regarding direct marketing activities);
  • to contact you for market research purposes;
  • to improve our products and services;
  • to understand our customer base; and
  • to evaluate Mazda dealers.

 

5.4 To whom do we disclose personal information?

We may disclose your personal information to third parties in connection with the purposes described in this policy.

This may include disclosing your personal information to the following types of third parties:

  • Mazda dealers;
  • any third parties to whom you have directed us to disclose your personal information (e.g. referees);
  • our related companies to assist in carrying out business in accordance with this policy;
  • our contractors (such as mailing houses, marketing agencies, insurance providers, website and data hosting providers and other IT suppliers) and other persons who perform services for us, so that they can perform those services for us;
  • social media platforms;
  • marketing tool providers;
  • companies who may use your personal information on our behalf in order to tailor our electronic advertising to you (e.g. on a webpage) in relation to our products and services;
  • our accountants, insurers, lawyers, auditors and other professional advisers, to the extent necessary for them to provide their services to us in connection with the operation and management of our business and not for their own independent purposes;
  • emergency service providers who may provide you with emergency assistance
  • government and law enforcement agencies and regulators, where permitted or required by law;
  • entities established to help identify illegal activities and prevent fraud where authorised by law; and
  • otherwise as permitted or required by law.

We may share your personal information, inside the Mazda Family of Companies and to potential investors in the group, but only to the extent necessary. If we go through a business transition, such as a merger, acquisition by another company, or a sale of all or a part of our business assets, your personal information may be among the assets transferred or to the extent necessary it may be provided in negotiations for the other party to use for the purposes of assessing or undertaking that business transition.

Where we disclose your personal information to third parties, we will use reasonable commercial efforts to ensure that such third parties protect your personal information in a manner consistent with this Privacy Policy.

Mazda does not sell your personal information or provide it to third parties to use for their own separate purposes, unless you direct us to, it is otherwise required or permitted by law, or where we give it to third parties in accordance with this policy where those parties have a separate relationship with you and use it in accordance with the agreements and disclosures they have provided to you in connection with that separate relationship.

Some information that you post to parts of our website or to our social media pages may be available to be viewed by the public.  You should use discretion is deciding what information you upload to such sites.

 

6. Direct marketing

Mazda Australia (or any of the entities which make up the Mazda Family including their agents and contractors (if any) acting on their behalf) may send you direct marketing to inform you about products or services, special offers, programs, promotions and events that may be of interest to you. These marketing communications may include joint promotions with Mazda dealers or other promotion partners and may be sent to you using any contact details provided by you, such as post, telephone, email or SMS.

Please note that the organisations comprising the Mazda Family are separate organisations. If you do not wish to receive marketing communications and surveys from a member of the network, you can let that organisation know at any time using the contact details in their respective privacy policies or utilising the “unsubscribe” or other opt-out function offered by the organisation in each marketing communication. You can also request that we stop sharing your personal information with those organisations for marketing purposes.

You can unsubscribe from our direct marketing by contacting us. You agree and acknowledge that even if you opt out of receiving information about future events or marketing material, we will still send you essential information that we are required to send you relating to the services we provide, such as urgent recall notices affecting your vehicle.

 

7. Security

We use all reasonable endeavours to keep your information in a secure environment and to protect your personal information from misuse, interference, loss, unauthorised access, modification or disclosure. If you reasonably believe that there has been unauthorised use or disclosure of your personal information, please contact us using the details below.

We keep records of the personal information we gather from you and that collected data is encrypted both at-rest and in-transit using the applicable industry standards. Personal information is stored securely on servers within our physically secured data centres with only authorized people allowed access.

If we no longer need your personal information, unless we are required under law or a court or tribunal order to retain it, we will take reasonable steps to destroy, securely delete, or de-identify your personal information as appropriate.

 

8. Data Retention

 We store, process, and retain your information only for as long as we need it for the purposes described in this Privacy Policy. When we no longer need your information, we take reasonable steps to destroy or de-identify it, unless we are required or authorised by law to retain your information for a longer period.

 

9. Disclosing your information overseas

We may disclose your information to organisations located overseas to support the purposes described in this policy. These include:

    • our parent company Mazda Motor Corporation in Japan and other Mazda entities overseas including in the UK, USA, and Singapore; or
    • our service providers that are located in, or hold data overseas including in the Singapore, Sweden, Japan, the United Kingdom, Hong Kong and The United States of America.

 

10. Accessing and correcting your personal information

You can generally access and request the correction of or removal of the personal information we hold about you by contacting us in any of the ways set out at the bottom of this policy. Please note that dealers are separate organisations, and as such may hold their own information about you.   You should contact your dealer direct regarding any details they may hold on you. 


11. Helping us

To ensure the information we hold is accurate, complete, up to date and relevant, you should:

    • notify us of the sale or transfer of your Mazda vehicle; and
    • notify us if you have purchased or acquired your Mazda vehicle outside of the Mazda Dealer network.

If you do not notify us of a sale, purchase, acquisition or transfer of a vehicle, we may continue to send communications in relation to that vehicle to the last known registered owner in our records.

 

12. Queries, comments and complaints

We welcome your queries or comments about our Privacy Policy and personal information handling practices.  

If you have any questions, concerns or complaints about our collection, use or disclosure of personal information, or if you believe that we have not complied with this Privacy Policy or the Act, please contact us.  When contacting us please provide as much detail as possible in relation to your question, concern or complaint.

Mazda will take any privacy complaint seriously and any complaint will be assessed by an appropriate person with the aim of resolving any issue in a timely and efficient manner.  We request that you cooperate with us during this process and provide us with any relevant information that we may need.  We will seek to respond to any complaint within a reasonable period of time.
